Terms of Use – Introduction

By using the store — whether as a consumer of products or services, or otherwise — you acknowledge your full legal capacity and agree to all terms and conditions of this agreement. Your use constitutes acceptance and commitment to comply with its provisions.

This agreement applies to all types of transactions between the consumer and the store and becomes valid and binding once you agree to it and begin registering on the store, pursuant to Article 10 of the Saudi Electronic Transactions Law.




Article 1 – Introduction and Definitions

The preamble above is an integral part of this agreement. Below are the key terms and definitions used herein:

  1. Kyan Kids Store: Includes all forms of the store available online, whether an electronic application, website, or physical retail outlet.
  2. Consumer: Any person engaging in e-commerce with the intention of obtaining products or services offered through the store’s online platform.
  3. Agreement: Refers to these terms and conditions governing the relationship between the parties to this agreement.




Article 2 – Legal Capacity of the Consumer

  1. The consumer acknowledges having full legal capacity under Sharia and applicable law to engage with Kyan Kids Store and that their age is not less than 18 years.
  2. In case of violation of this clause, the consumer shall bear full responsibility for any consequences arising therefrom.



Article 3 – Nature of Commitment

  1. The store’s primary commitment to consumers is to provide the service or product offered.
  2. The store may also provide additional services such as after-sales support or other related services, depending on the nature of the purchased product or service.




Article 4 – Usage Regulations

  1. The consumer agrees to use the store’s electronic platform in compliance with public morals and applicable laws and regulations in the Kingdom of Saudi Arabia.
  2. The consumer agrees not to use any service or product purchased from the store in any way that violates public morals or Saudi law.



Article 5 – Accounts and Registration Obligations

Upon applying for membership or registering as a user of Kyan Kids store, you are required to disclose specific information and choose a username and confidential password to access store services. You hereby agree to:

  1. Be responsible for maintaining the confidentiality of your account information and password, and to notify Kyan Kids Store immediately of any unauthorized use or security breach.
  2. The store shall not be liable for any direct or indirect loss, whether moral or material, resulting from the disclosure of your username or password.
  3. You agree to personally use your account and are fully responsible for all actions taken under it. Use by another person will be deemed authorized by you.
  4. You agree to use the store seriously and honestly.
  5. You agree to provide true, accurate, current, and complete information about yourself during registration at Kyan Kids store and to update it when necessary.
  6. The store undertakes to treat your personal and contact information with full confidentiality.
  7. If the store determines that you have provided false, inaccurate, outdated, or incomplete information, Kyan Kids Store reserves the right to suspend, freeze, or cancel your membership or account without prejudice to its other legal rights.
  8. Failure to comply with the above terms gives the store the right to suspend, cancel, or restrict your access to its services at any time.




Article 6 – Electronic Communications and Official Channels

  1. The parties agree that communication shall take place via the email registered on the platform.
  2. The consumer agrees that all agreements, announcements, statements, and other communications provided electronically shall have the same legal effect as written documents.
  3. The consumer agrees to receive notifications or communications related to this agreement through public or direct messages sent by the store administration.




Article 7 – Amendments and Fees

  1. If any provision of this agreement becomes invalid or unenforceable, the remaining provisions shall remain in full force until otherwise notified by the store.
  2. This agreement — subject to amendment as necessary — forms the understanding and framework of the relationship between the consumer and the store.
  3. The store may impose fees on certain consumers depending on offers, products, services, or government taxes applicable to specific items.
  4. The store reserves the right to add, increase, reduce, or deduct any fees or expenses in accordance with this agreement and applicable laws.




Article 8 – Payment and Settlement Services

  1. The store provides payment and settlement systems through its partners, which may include online payment methods or any other means introduced periodically.
  2. The store commits to pricing its products or services according to prevailing market values.
  3. The store must issue invoices, receipts, and delivery confirmations for all transactions and provide the consumer with a purchase receipt.
  4. The store shall maintain accounting standards recognized for e-commerce in compliance with this agreement and relevant legal and economic principles.



Article 9 – Intellectual Property

  1. The intellectual property rights of the store are fully owned by the store, whether they were acquired before or after the establishment of this online platform.
  2. The consumer shall respect the store’s intellectual property rights, including the store’s name, words, logos, and other symbols associated with the store or displayed on it, as all rights related to the store’s name are fully owned intellectual property of the store.



Article 10 – Store Liability

  1. The store commits to conducting its commercial activities through this online platform legally and in accordance with the laws and regulations in force in the Kingdom of Saudi Arabia, and pursuant to the provisions of this agreement.
  2. The store shall not be held liable for any claims arising from errors or negligence, whether directly, indirectly, incidentally, by the consumer, or by a third party such as shipping companies.
  3. Kyan Kids Store and its employees, owners, and representatives commit that the products or services offered are legitimate, lawful, and authorized under the laws and regulations of the Kingdom of Saudi Arabia, and are to be used for legal purposes.



Article 11 – Access or Membership Restriction

The store may suspend or cancel a consumer’s membership or restrict their access to the platform’s services at any time, without prior notice, for any reason, and without specification.



Article 12 – Governing Law

This Terms of Use Agreement is governed by and drafted in accordance with the laws, regulations, and legislation in force in the Kingdom of Saudi Arabia and is fully subject to the applicable authorities in the Kingdom.



Article 13 – General Provisions

If any clause or provision in this Terms of Use Agreement is canceled or becomes unenforceable, this shall not affect the validity of the remaining clauses and provisions, which shall remain in effect until further notice from the store management.

This Terms of Use Agreement – which may be amended from time to time as necessary – constitutes the agreement, operational procedure, understanding, and contract between the store and the consumer. Both parties agree to the following:

  1. Arabic is the official language for interpreting the provisions of this agreement or when translating it into another language.
  2. All prices displayed for the store’s products or services may change from time to time.
  3. Promotional or marketing offers by the store are temporary, and the store reserves the right to modify or discontinue them at any time.
  4. The parties to this agreement must conduct their dealings in compliance with Sharia rules and applicable laws and regulations related to the nature of transactions between the store and the consumer.
  5. This Terms of Use Agreement can only be terminated by a decision issued by the store management.
